TERMS AND CONDITIONS

1. DEFINITIONS
To allow full understanding and acceptance of these terms, the following terms, in singular and plural, shall have the meanings indicated below:

Aeffe Lab s.r.l.: the owning company with registered office at Via Capestrano, 10 – 66100 Chieti (VAT 02479750693).

phobia-archive.com: the website operated by Aeffe Lab s.r.l. It is an e-commerce platform for the purchase of clothing and accessories produced internally or by third parties.

Products: the products and/or services offered through phobia-archive.com.

User: the person accessing phobia-archive.com, regardless of legal nature or purpose, interested in the Products offered through phobia-archive.com.

Consumer: a natural person acting for purposes unrelated to any entrepreneurial, commercial, or professional activity.

Terms: this contract governing the relationship between Aeffe Lab s.r.l. and Users regarding the sale or supply of Products offered through phobia-archive.com.

2. FORMATION, CONCLUSION, AND EFFECTIVENESS OF THE TERMS

The contract for the purchase of Products is concluded upon the correct completion and submission of the order. This form includes the purchaser’s and order data, the price of the purchased Product, any additional charges, the payment methods and terms, the delivery address, delivery times, the existence of the right of withdrawal, as well as consent to the processing of personal data.

When Aeffe Lab s.r.l. receives the User’s order, it sends a confirmation email or displays a printable web page confirming the order and summarizing the details referred to above.

The Terms are not considered effective between the parties in the absence of the above confirmation.

Aeffe Lab s.r.l. may modify or simply update these Terms, in whole or in part. The User acknowledges and agrees that any modification to these Terms will apply to orders submitted after the date of communication of the change. The User is therefore invited to consult the Terms at each access to phobia-archive.com and is advised to print a copy for future reference.

3. REGISTRATION

To access certain features of phobia-archive.com, Users must register by providing truthful and complete information requested in the registration form and fully accept the Privacy Policy and these Terms. Users are responsible for keeping their login credentials confidential.

Aeffe Lab s.r.l. shall not be held liable in any case for the loss, disclosure, theft, or unauthorized use of User credentials by third parties for any reason.

4. ACCOUNT DEACTIVATION AND CLOSURE

Registered Users may deactivate their account or request its deletion through the phobia-archive.com interface, if available, or by sending a written communication to Customer Service.

Aeffe Lab s.r.l. reserves the right to suspend or close a User account at any time without notice in the event of violation of these Terms or applicable laws.

5. PURCHASES ON PHOBIA-ARCHIVE.COM

Purchasing one or more Products via phobia-archive.com is allowed for both Users who qualify as Consumers and those who do not.

Pursuant to Article 3, paragraph 1(a) of Legislative Decree 206/2005 (“Consumer Code”), natural persons acting for purposes unrelated to entrepreneurial, commercial, professional, or artisanal activities are recognized as Consumers.

Only persons 18 years of age or older are authorized to purchase.

Aeffe Lab s.r.l. undertakes to describe and present Products on phobia-archive.com to the best of its ability. However, errors, inaccuracies, or minor differences may occur between phobia-archive.com and the product actually received. Product photographs on phobia-archive.com are representative only and are not contractually binding.

The User expressly grants Aeffe Lab s.r.l. the right to partially accept an order (e.g., if not all Products are available). In this case, the contract is concluded only for the Products actually sold.

Aeffe Lab s.r.l. reserves the right to refuse or cancel an order:

When the Product is not available;

When authorization to charge the User’s payment method is denied;

When an obviously incorrect and recognizable price is indicated at the time of purchase.

In such cases, the User will be contacted by Customer Service and refunded for the transaction.

6. PRICES AND PAYMENTS

Aeffe Lab s.r.l. reserves the right to modify at any time the price of Products and any shipping costs. Such modifications do not affect contracts already concluded.

Product prices include VAT, if due; any other taxes and/or shipping costs will be indicated before purchase confirmation.

The User agrees to pay the price of the purchased Product according to the methods and terms indicated on phobia-archive.com.

Refunds to the User will be credited promptly after careful inspection of the returned Product, using one of the methods offered by Aeffe Lab s.r.l. and chosen by the User, and in case of exercising the right of withdrawal, no later than 14 days from the date Aeffe Lab s.r.l. became aware of the withdrawal, subject to delays in the return of the product.

Phobia-archive.com uses third-party payment tools, and Aeffe Lab s.r.l. does not access payment data (credit card numbers, cardholder names, passwords, etc.).

If third-party tools deny payment authorization, Aeffe Lab s.r.l. cannot supply the Products and is not responsible for delays or failed deliveries.

Payment methods:

PAYPAL
Customers can pay via PayPal using their PayPal account according to the service conditions at the time of payment.

CREDIT / DEBIT CARD
For credit card payments, card data submitted during ordering is protected and sent directly to the banking company processing the payment. Payment occurs on a secure server with SSL encryption. Card data is not accessible to the Seller or any third party, neither at the time of order submission nor afterwards. Payments are accepted via Visa, MasterCard, American Express, Apple Pay, and related circuits.

INSTALLMENT PAYMENT
For payments via Klarna, the customer receives the order immediately and pays in installments. Installments may be assigned to Klarna, affiliated parties, or their assignees, and the customer authorizes such assignment.

7. INVOICING

Users wishing to receive an invoice must provide billing information at purchase and request it personally via email to Customer Service. The data provided by the User will prevail, who declares its truthfulness, releasing Aeffe Lab s.r.l. from any related liability.

8. DELIVERY OF PHYSICAL PRODUCTS

“Physical Product” refers to any tangible or digital goods provided on a material medium offered via phobia-archive.com.

Physical Products will be delivered to the User at the address provided, in the manner chosen by the User or indicated on phobia-archive.com at purchase. Delivery will occur within the times indicated in the order confirmation.

Upon receipt, the User must verify the conformity of the package and product with the order. Any visible damage or discrepancies must be promptly reported.

If an order exceeds stock availability, Aeffe Lab s.r.l. will notify the User by email and confirm product availability or waiting times.

Aeffe Lab s.r.l. is not responsible for delays or non-delivery due to force majeure, including but not limited to accidents, strikes, natural disasters, etc.

9. PRODUCT INFORMATION

All Products on phobia-archive.com include detailed descriptions, which may contain images, technical details, and other useful information for purchase. Aeffe Lab s.r.l. is not responsible for errors or inaccuracies.

10. USER RESPONSIBILITY

The User assumes full responsibility for the use of purchased Products and agrees to use them in accordance with applicable laws and instructions.

11. RIGHT OF WITHDRAWAL

As a Consumer, the User may withdraw from the contract within 14 days from delivery without providing any reason. The period begins when the User or a designated third party takes physical possession of the Products. Return costs are the responsibility of the customer. To exercise the right of withdrawal, the User must send an explicit communication to Aeffe Lab s.r.l. via the dedicated form.

12. PRODUCTS NOT SUBJECT TO WITHDRAWAL

The right of withdrawal does not apply to sealed goods unsuitable for return for hygiene or health protection reasons, once opened after delivery.

13. FORCE MAJEURE

Aeffe Lab s.r.l. is not responsible for delays or failure to fulfill obligations due to force majeure, including but not limited to wars, strikes, illnesses, health emergencies, energy supply interruptions, or transportation delays.

14. PRODUCT WARRANTY

Products are guaranteed against manufacturing defects and non-conformity for two years from delivery. In case of non-conformity, the User has the right to replace the Product at no extra cost.

15. CLAIMS AND REQUESTS

For any issues or requests regarding purchased Products, the User may contact Customer Service, which will respond within a reasonable time.

16. PERSONAL DATA PROTECTION

User personal data is processed by Aeffe Lab s.r.l. in accordance with privacy regulations and the Privacy Policy on phobia-archive.com.

17. AMENDMENTS TO THE CONTRACT

Aeffe Lab s.r.l. reserves the right to modify these Terms at any time. Changes do not affect already confirmed orders.

18. GOVERNING LAW AND JURISDICTION

These Terms are governed by Italian law. Any dispute regarding interpretation, execution, or validity will be subject to the exclusive jurisdiction of Chieti.

19. LIMITATION OF LIABILITY

Aeffe Lab s.r.l. is not responsible for damages resulting from issues beyond its control, including internet failures, third-party fraud, or improper use by the User.

20. PARTIAL INVALIDITY

If one or more provisions are declared null or ineffective, the validity of the remaining provisions shall not be affected.

21. THIRD-PARTY LINKS

phobia-archive.com may contain links to third-party websites. Aeffe Lab s.r.l. is not responsible for their content.

22. COMMUNICATIONS

Official communications must be sent in writing to Aeffe Lab s.r.l. Customer Service or via email at the contact indicated on phobia-archive.com.

23. INVALIDITY OF INDIVIDUAL CLAUSES

If any provision is considered invalid, the remaining Terms remain effective.

24. PRIVACY

The protection of personal data is governed by the Privacy Policy available on the site.

25. ONLINE DISPUTE RESOLUTION FOR CONSUMERS

Consumers residing in Europe can use the EU Online Dispute Resolution platform: http://ec.europa.eu/consumers/odr/

26. PRICES AND CURRENCY

Prices are expressed in Euro (EUR), except for Users in the United Kingdom or United States, where prices are in Pounds (GBP) or Dollars (USD), respectively. Payments are processed in Euro, and exchange rates may vary.

27. CONCLUSION

These Terms fully govern the relationship between Aeffe Lab s.r.l. and the User and prevail over any prior agreement.
